不动产登记，为何动不起来

今年3月1日，《不动产登记暂行条例》（简称《条例》）正式实施，一个多月来，全国还有超过84%和96%的地市和县没有完成不动产登记职责整合。

近日国土部与中央编办联合下发

《关于地方不动产登记职责整合的指导意见》，要求各地确保年内完成各级不动产登记职责和机构整合。

《条例》已满月，只有50个地市、101个县完成了不动产登记职责整合，占比分别不到16%和4%。所谓的不动产登记，俨然变成了不动产不登记，令人五味杂陈。96%的县没有动起来，显然原因复杂，比如《条例》从施行到落地，难免需要时间；再比如由于职责和机构整合尚未到位，缺乏实施主体也使得登记难以推进。

除此之外，是否与相关部门缺乏热情和动力有关？

比如为官不为，导致政令不通。

在3月15日的^v^常务会议上，^v^总理^v^怒称：

“部长们参加的^v^常务会议已经讨论通过的一些政策，现在却还‘卡’在那儿，难道让几个处长来‘把关’，这不在程序上完全颠倒了吗？” 与政策相比，《条例》无疑更重要，也具有强制力，却推行不畅，是不是也与处长“把关”有关？

不管这种情况存不存在，都应该正视“上面九级风浪，下面纹丝不动”的状况。

《条例》没有动起来，或因受到阻力。

尽管《条例》并不具备反腐功能，但一旦施行

一些官员灰色财产或将暴露，特别是对那些坐拥数套、十多套乃至数十套住房的官员来说，他们不仅不愿意推动《条例》动起来，甚或暗自设置障碍。其实，《条例》对反腐并非毫无作用，正如参与《条例》制定的清华大学法学院副教授程啸所称，《条例》规定将统一建立不动产信息管理基础平台，确保国家、省、市、县四级信息共享，这对于打“老虎”来说，确实有一定帮助，只要经过一个平台就可查询特定个人名下的全部不动产。

不怕慢，就怕站。那些尚未行动起来的地方，应该快马加鞭。按照国土部、中央编办日前联合下发的《关于地方不动产登记职责整合的指导意见》的要求，确保年内完成各级不动产登记职责和机构整合工作。如果连职责和机构整合都不愿意做，不动产登记恐怕遥遥无期。由于不动产实行属地登记，市县两级是不动产登记工作的关键，即便各地整合了统一登记的职责和机构，也需要有使命感和紧迫意识，不能拖，更不能凝滞不动。

当然，除了各地行动起来，中央也需形成制度安排。据国土部不动产登记局负责人此前表示，《不动产登记暂行条例实施细则》即将完成征求意见，修改完善后将尽快颁布实施。也许有了实施细则，各地就更容易动起来。

《条例》可谓命运多舛，尚未出生已是争议四起，好不容易出台后，仍然备受质疑。早前有学者预计，《条例》实施绝不会是一块好啃的骨头。与其说一语成谶，毋宁说这是基于现实的清醒认知，《条例》既已出台，就应该不折不扣落实，哪怕阻力再大，哪怕再有复杂状况，也不能却步。为了确保《条例》推行更顺畅一些，理应在出台实施细则的同时，强化问责机制。

《不动产登记暂行条例》

第一章总

第一条为整合不动产登记职责，规范登记行为，方便群众申请登记，保护权利人合法权益，根据《^v^物权法》等法律，制定本条例。

第二条本条例所称不动产登记，是指不动产登记机构依法将不动产权利归属和其他法定事项记载于不动产登记簿的行为。

本条例所称不动产，是指土地、海域以及房屋、林木等定着物。

第三条不动产首次登记、变更登记、转移登记、注销登记、更正登记、异议登记、预告登记、查封登记等，适用本条例。

第四条国家实行不动产统一登记制度。

不动产登记遵循严格管理、稳定连续、方便群众的原则。

不动产权利人已经依法享有的不动产权利，不因登记机构和登记程序的改变而受到影响。

第五条下列不动产权利，依照本条例的规定办理登记：

（一）集体土地所有权；

（二）房屋等建筑物、构筑物所有权；

（三）森林、林木所有权；

（四）耕地、林地、草地等土地承包经营权；

（五）建设用地使用权；

（六）宅基地使用权；

（七）海域使用权；

（八）地役权；

（九）抵押权；

（十）法律规定需要登记的其他不动产权利。

第六条 ^v^国土资源主管部门负责指导、监督全国不动产登记工作。县级以上地方人民政府应当确定一个部门为本行政区域的不动产登记机构，负责不动产登记工作，并接受上级人民政府不动产登记主管部门的指导、监督。

第七条不动产登记由不动产所在地的县级人民政府不动产登记机构办理；直辖市、设区的市人民政府可以确定本级不动产登记机构统一办理所属各区的不动产登记。

跨县级行政区域的不动产登记，由所跨县级行政区域的不动产登记机构分别办理。不能分别办理的，由所跨县级行政区域的不动产登记机构协商办理；协商不成的，由共同的上一级人民政府不动产登记主管部门指定办理。

^v^确定的重点国有林区的森林、林木和林地，^v^批准项目用海、用岛，中央国家机关使用的国有土地等不动产登记，由^v^国土资源主管部门会同有关部门规定。

第二章不动产登记簿

第八条不动产以不动产单元为基本单位进行登记。不动产单元具有唯一编码。

不动产登记机构应当按照^v^国土资源主管部门的规定设立统一的不动产登记簿。

不动产登记簿应当记载以下事项：

（一）不动产的坐落、界址、空间界限、面积、用途等自然状况；

（二）不动产权利的主体、类型、内容、来源、期限、权利变化等权属状况；

（三）涉及不动产权利限制、提示的事项；

（四）其他相关事项。

第九条不动产登记簿应当采用电子介质，暂不具备条件的，可以采用纸质介质。不动产登记机构应当明确不动产登记簿唯

不动产登记簿采用电子介质的，应当定期进行异地备份，并具有唯

不动产登记机构应当加强对不动产登记工作人员的管理和专业技术培训。

第十二条不动产登记机构应当指定专人负责不动产登记簿的保管，并建立健全相应的安全责任制度。

采用纸质介质不动产登记簿的，应当配备必要的防盗、防火、防渍、防有害生物等安全保护设施。

为了进一步提高我市城区清扫保洁和生活垃圾清运质量，根据上级关于事业单位管理与作业职能分离的要求，通过招标程序确定乙方为路段的中标人。根据《合同法》的规定和承包方案，在平等、自愿、等价有偿的基础上，特签订承包合同如下：

第六条双方约定的工作事项

(一)承包人承包后不得以任何形式转包。

(二)乙方承包后享有用人权，但除新增人员外，应主要聘用现有从业人员。

(三)乙方须缴纳承包抵押金，甲方正式职工万元，外部人员万元。押金不计利息，合同期满后乙方无违约事项的，甲方负责在15日内退还本金。

(四)乙方应与聘用人员之间签订聘用合同，明确双方的权利和义务及劳动报酬，乙方聘用人员出行安全责任事故的协调、处理由乙方负责，甲方协助，发生的赔偿费用等由甲乙双方协商解决。

(五)甲方因上级政策的变化而需要中止同时，应及时通知乙方，如因此对乙方造成经济损失的应给予一定的补偿。

(六)乙方安排的工作量不得突破国家劳动定额。

第七条甲方的权利和义务：甲方有权对乙方的.清扫保洁情况进行监督，对发现的问题要求其及时整改。甲方有义务为乙方完成承包任务和按质履行承包合同提供必要的条件，有义务协助乙方解决工作纠纷。

第八条乙方的权利和义务：乙方有权利要求纠纷按期支付承包费，有义务遵照《劳动法》和甲方制定的有关劳动

第九条合同的变更解除或终止：本合同生效后即具体法律约束，甲、乙双方均不得随意变更或解除。本合同需要变更或解除时，须经双方协商一致达成新的书面协议。在新的书面协议未达成之前，本合同依然有效。

本合同履行期间，如国家有关政策与合同签订时相比，甲乙双方任何一方利益受到重大影响，受影响的一方可以提出变更或解除本合同。

由于不可抗力的原因使本合同无法继续履行时，经双方协商一致可以变更或解除本合同。

如因甲乙双方其中一方的原因，在承包区域内因大面积的停止清扫保洁，造成恶劣的社会影响时，双方将有权立即终止合同，属乙方责任的不退保证金，并根据情况作其他处理，属甲方责任应双倍退还保证金。

第十条违约责任

(一)承包方不及时按要求支付工人工资及福利，引起工人投诉的，每次扣发承包费1000元。

(二)发包方甲方不能按合同规定及时支付承包费时，拖延每日按当月应支付费用的1%支付滞纳金。

(三)甲乙双方任何一方违反本合同规定，应承担违约责任，赔偿因违约给对方造成的直接经济损失。

第十一条乙方的投标方案为本合同附件。上述文件材料如与本合同正文有矛盾的，以本合同正文为准。

第十二条本合同一式份，所办公室和及乙方各存一份，签字盖章后生效，到期自行终止。

第十三条甲乙双方在履行本合同时发生争议，可先协商解决，协商不成，依法申请仲裁或提起诉讼。

兹有甲方房屋一套，地址：____________，自愿租给乙方使用。

双方友好协商，达成如下协议：

一、租期暂定壹年。即从________年_________月_________日起至________年_________月_________日止，先付房款后住房。
