甲方在村东新建一栋办公楼，同意该办公楼的土建工程以包工包料形式承包给乙方施工。依照《_建筑法》、《_合同法》及有关法律法规，本着*等互利的原则，结合本工程具体情况，经甲、乙双方协商达成以下合同条款：

2、乙方要包以下项目：
1)、主体工程：该工程为框架结构，层高按设计图纸施工。
2)、装饰工程：①内墙面用水泥砂浆批灰。②外墙面刮涂料。③楼面、地面面层为水泥浆。
五、工程款支付方式：
1、乙方三层屋面封顶付工程造价总额的15%。
2、待柱体完工甲方付给乙方工程造价总额的15%。
3、工程全部完工时甲方付乙方工程造价总额的30%。
4、工程全部完工验收合格，________年腊月(农历)三十前甲方付给乙方工程造价总额的35%。其余的5%保证金，若无质量问题，甲方待一年后付清。
六、施工工期：
1、经甲、乙双方协商：从施工基础承台开始至竣工验收合格即________年____月____日开工至________年____月____日竣工。
2、因不可抗拒的客观情况影响工程进度的，经甲、乙双方协商，工期可相应顺延。
七、甲方的工作及责任：
1、必须办理好项目的报建手续及施工临时用地占用道路等合法手续，并承担此工作应由甲方出费用。
2、工程开工前，做好工程的“三通一*”，将施工用的水、电线路接通到施工场地，铺设好临时的运输道路，满足施工要求，并承担以上工作的费用。
3、开工前、准确提供建筑物四大角位置的控制点、水准点及±位置。
4、开工前，由甲、乙双方组织图纸会审和技术交底。协商一致，方可施工。
5、甲方应按合同约定的工程部位支付工程进度款，如违约支付，责任由甲方负责。
八、乙方的工作及责任：
1、乙方在施工中必须有足够的建筑材料和建筑机械，以保证工作项目的顺利完成。乙方施工提供地下管线布设情况，*整场地清除地上、地下障碍物等，处理邻近建筑物保护工作，并承担以上工作的费用和安全责任。
2、乙方处理地下管线及临近建筑的保护工作。
3、乙方必须按甲方提供的图纸及相关建筑法律、法规、强制性标准施工。在工程质量方面同要达到国家规定的质量验收合格标准，并按规定的时间完成任务整个工程项目。
4、在施工过程中，乙方必须服从甲方代表(或监理人员)的监督，加强各班组人员的管理。提高安全施工意识，做好安全文明施工工作。如出现安全事故或打架斗殴事件所造成的一切损失，概由乙方负责。
5、施工场地乙方必须保持清洁，对已完成的工程未交付甲方使用之前，乙方应对成品派专人保管和保护。
6、施工单位的工人的所有保险费用以及施工安全文明措施由乙方负责。
7、一切建筑材料均由乙方采购与保管，材料品牌、规格、颜色由甲方认可。主要建筑材料须送检合格后方可用于该工程中。
8、施工临时设施如临时围挡，乙方负责人工。临时工棚办公室、施工需要的水、电管线安装的费用由乙方负责。
9、乙方协助甲方办理好施工报建等有关手续。
10、乙方需按时发放工人工资和及时支付材料款，如乙方拖欠工资或材料款，与甲方无关。
11、所有的检测费包括桩检费用、材料送检费均由乙方负责。
12、做好工程资料及材料送检的一切费用由乙方负责。工程竣工验收后，乙方尽快为甲方办理好工程资料，如因乙方工程质量原因或资料不合格应由乙方负责(注：由甲方负责验收)。
九、工程质量要求：
1、乙方应严格按照现行施工验收规范，按照甲方提供的设计图纸进行施工。隐蔽工程须经甲方及监理人员验收合格后，才能进行下一道工序的施工。
2、工程质量不合格全部返工，一切责任由乙方负责。
3、在施工现场如发现不足之处，甲乙双方必须及时会同有关人员协商采取补救措施，以防止扩大损失，保证工程质量和工程的顺利进行。
十、工程变更及工程结算
1、在施工过程中，甲方确需进行结构变更时，须经设计单位同意，并出具设计变更单给乙方，方可继续施工。同时作为竣工结算与交工验收的依据。
2、由于工程变更不及时而引起某部位的返工，造成直接经济损失的费用由乙方负责。
3、如工程内容发生增减变化，按甲乙双方协商的单价计算，相应增减工程造价。
十一、补充说明
1、筋使用线材及螺纹材。
2、水泥使用：装饰、砌墙使用水泥;结构所用的砼全部为商品混凝土(注：砼按图纸设计施工)。
3、墙体材料用机制一级页岩砖或红砖。
4、排水管采用联塑或雄塑管。
5、防盗门、玻璃门、卷闸门(由甲方指定品牌)。
6、按图施工。
十二、工程保修：本工程竣工后一年内属乙方保修期，保修期间如属乙方质量问题由乙方负责保修。因不可抗拒或自然灾害原因或甲方使用不当造成的问题不属乙方保修范围。
十三、施工过程中如发现与本合同未提及的事项，双方另行协商。
十四、本合同一式两份，甲乙双方各执一份，本合同自甲乙双方签字盖章之日起生效。

(3)严格按照施工规范进行施工，保证工程质量。在施工过程中，如有人为阻挡，人员、机械误工费照价计算由甲方全部负责赔偿。
(4)制定安全技术措施，承担安全事故所发生的费用。
七、违约责任
本合同签字盖章后生效，双方都要认真履行合同条款，如一方有违约行为，则按合同约定的条款执行(违约方赔偿对方总造价30%的违约金)，并按照《_合同法》的有关条款追究违约方的责任。
八、附则
1、本合同一式六份，合同双方各执一份(六七八九)社社员代表各一份。

第三条 工程合同造价：

2.按照第八条标准按实际工程量进行结算
在市委创先争优办的指导下，我局党组高度重视，建立领导机构，制定实施方案，顺利推进了该项活动的开展，并取得了阶段性成效。现将有关情况报告如下：
一、主要做法
（一）召开“创先争优”活动宣传发动会。在宣传发动会上，局党组副*周立代表局党组就“创先争优”活动进行了详实的安排部署。
（二）设置党员示范窗口和党员先锋岗。我局将深入开展“创先争优”活动与效能建设年活动紧密结合起来，在财政支付中心设置了党员示范窗口，为每一位党员制作了“党员先锋岗”的标牌，以创先争优促作风建设，促效能提升。
（三）开展公开承诺活动。紧密结合财政工作实际和岗位职责情况，机关各党支部向党员和群众承诺创争目标和具体措施；每一个党员对照“五带五争”标准自查，提出了书面承诺，接受组织和群众监督。
（四）开展党员民主评议活动。把创先争优作为党员民主生活会的主要内容，通过分支部召开座谈会的形式，谈对创先争优活动的认识，对照优秀*员的标准开展批评和自我批评，对照先进基层党组织的标准提建议和意见。
（五）加强基层党组织制度建设。按照党建工作科学化、制度化、规范化的要求，狠抓基层党组织工作制度建设。近日，局党组对机关党组织主要工作制度进行了汇编，并作为加强党员干部学习教育读本印发到了全体党员手中。
二、取得成效
“创先争优”活动开展以来，我局始终坚持将活动与推进财政工作和机关行政效能建设相结合，取得了明显成效。
（一）实现财政收入较快增长。全局党员干部把创先争优活动作为推进财政科学发展的强大动力，自觉践行公开承诺，发挥模范带头作用，带动全局形成促进财政稳步发展的良好局面。截止11月30日，全市地方财政收入完成万元，同比增长。其中：一般预算收入万元,同比增长。税收收入实现万元,同比增长；非税收入万元，同比增长。
（二）积极争取上级财政支持。创先争优活动的开展，充分调动了全局党员干部的工作积极性，抢抓机遇，正视困难，求实奋进。为缓解财政支出压力，除大力采取增收节支措施外，20xx年，通过加强与省厅的衔接，共争取各项补助资金亿元，比上年增加亿元，其中：地震重灾区过渡期财力补助6898万元，省上追加的城镇居民住房恢复重建补助资金13600万元，地方*债券转贷资金7000万元，目前到位村级公益事业建设“一事一议”财政奖补资金522万元，现代农业生产发展资金项目控制指标1020万元。
（三）大力推行制度创新。提高财政科学化、精细化、规范化管理水*是促进财政科学发展的必然要求，也是创优争先活动与财政工作结合要实现的具体目标。我局做了大量的工作：一是调整和完善乡镇财政体制，研究制定了《乡镇财政激励约束考核评分办法》。二是制定《关于进一步加强市级非税收入管理的意见》，加强了非税收入的监督管理。三是制定《财政支付中心财政专项资金特设帐套管理办法（试行）》，加强账户设置管理，规范单位会计核算行为。四是推进国库集中支付制度改革，做好了明年在全市行政事业单位全面运行“大*台”各项准备工作。
三、存在问题
由于*时财政业务工作繁忙，造成学习时间得不到充分保证，学习不够深入；学习形式也主要以集中学习和自学为主，形式创新不够。
四、20xx年工作打算
按照我局制定的《深入开展创先争优活动实施方案》的步骤要求，开展“全面争创”和“整体提升”阶段的各项活动。主要措施包括：
（一）开展承诺活动，促使党员模范带头争优秀。全面开展局党总支部、党员公开承诺，通过公告栏、宣传栏对承诺事项进行公示，主动接受党员群众监督。
（二）抓好典型宣传，发挥优秀党员的示范作用。在本单位大力宣传开展创先争优的活动的好经验、好做法，以及各行各业先进基层党组织和优秀*员。

A copy of all the paid utility bill be forwarded to the LESSOR every three month regularly. In case of disconnection of any facility due to non-payment, LESSEE will be responsible to get them restored and pay the same. All dues must be cleared before the expiry of the LEASE.
6. The LESSEE shall keep and maintain the said premises in good and tenantable conditions during the tenure of the lease.

1. To pay all existing and future rate, taxes assessments and other charges of a public nature whether impose by the Municipality, Government or any other authority in respect of DEMISED PREMISES.
2. Not to erect or set up a building or structure on the DEMISES PREMISES nor to add to any existing building or structure during the period of lease or any renewal without the written consent of the LESSEE.

、施工过程中，由于甲方原因需要返工的，则须经甲方签证认可后按实结算；养护期间由于乙方原因、自然原因、其他人为原因找不到肇事者的情况造成苗木死亡、损坏的，乙方必须按协议规格要求无条件给予及时补植；
、施工内容包括种植场地造型、整治、种植前土壤处理、种植土的回填、种植穴、槽开挖；苗木运输；苗木种植前的修剪；树移植、施肥保养及成活等全部工作内容。（养护期一年）
、乙方自供植物进行栽种，期满成活率应达100%。
甲供苗木栽种及管护

小叶榕及黄葛数共20xx棵，暂定工程价款为人民币小写3120_元，大写：叁拾壹万贰千元整，一次性包干价，包工包料，不另计任何费用。（数量以收方为准，实际价款以各方共同审定的结算为准）
播草籽单价：3元/*方米。（面积以收方为准）
甲供树苗栽种及养护
、栽种费：存活的按20元/棵计算，死亡的按10元/棵计算（含种植所需的.苗木吊装、场地*整、机械开挖、坑槽开挖、苗木二次转运、树木支撑等发生的一切费用）。
、外运种植土按38元/立方米，沙按45元/立方米计算。东坡档墙下及65#楼前地块乔木所需种植土厚度按40CM计算，播草的位置沙厚度按5CM计算，面积以实际收方为准。

六、工程保修
乙方自供植物种植部分
承包人应保证苗木在一年的养护期成活率达到100%，否则承包人应及时负责更换并承担全部费用；承包人不及时更换的，发包人有权另行委托他人栽培，由此产生的费用发包人有权直接从承包人保修金中扣除。
七、违约责任
乙方延误工期的，按工程总造价1%每日的标准向甲方支付违约金。
八、争议解决
因履行本合同发生争议，双方应友好协商解决，协商不成，可向工程所在地人民法院起诉。
九、协议生效与终止
本协议经各方签字、盖章后生效。本协议一式六份，各方各执叁份，均具有同等效力。

Article 10 Inspection of Analysis & Weight
The shipmentinspection and analysis shall be done byCCICappointed by the Seller and one independent surveyor (.: SGS or Geo-Chem, etc) appointed by the buyeras agreed by both parties at site before loading to container. Article 12 Force Majeure
The Seller shall not be responsible for the delay of shipment or non-delivery of the goods due to Force Majeureunder UCP 600. The seller shall advise the buyer immediately of the occurrence mentioned above and within 3 days thereafter the seller shall send a notice by courier to the buyer of their acceptance of a certificate of the accident issued by the local chamber of commerce under whose jurisdiction the accident occurs as evidence thereof. Under such circumstances the seller , however, are still under obligation to take all necessary measures to hasten the delivery of the goods. In case the accident lasts for more than 60 days the buyer shall have the right to cancel the Contract.
Article 13 Arbitration
All disputes arising out of or in connection with this Contract shall be finally resolved by arbitration in accordance with the Rules of Arbitration of the International Chamber of Commerce (UCP-600/20xx or Uniform Customs and Practice for Documentary Credits) by one or more arbitrators appointed in accordance with the said rules. In accordance with Client’s request, Guangxian shall provide legal training for

. Documents Legal Review文件的法律审查
In accordance with Client’s request, review or draft any documents with legal binding force or take any obligation, including but not limit to post, publicity, representation, advertisement words, external promise or bids;

. Deals Introduction
